These Terms of Service ("Terms") govern your use of this website at brkslabs.com (the "Site"), operated by LIMITED LIABILITY COMPANY "BRKS Labs" (EDRPOU 45737101), a Ukrainian limited liability company with registered office at 02068, Kyiv, Drahomanova St. 42, apt. 32, Ukraine ("BRKS Labs", "we", "us").

By accessing the Site, you agree to these Terms. If you do not agree, do not use the Site.

The Site is an informational platform describing our services. These Terms do not create a commercial engagement between you and BRKS Labs. Any paid engagement is governed by a separately signed Master Services Agreement, Statement of Work or equivalent written contract, which prevails over these Terms for that engagement.

You agree not to:

• Use the Site in violation of any applicable law;
• Attempt to breach the security of the Site, or probe, scan or test its vulnerability without prior written consent;
• Interfere with the operation of the Site, introduce malware, or attempt to disrupt service to other users;
• Scrape, harvest, or use automated means to extract content other than via normal browsing or publicly-documented interfaces.

All content on the Site — including text, graphics, logos, code and design — is the property of BRKS Labs or its licensors and is protected under Ukrainian and international intellectual property laws. You may view and share this content for non-commercial, informational purposes with attribution. Any other use requires our prior written consent.

The Site may link to third-party websites. We are not responsible for the content, practices or availability of those sites. Following a third-party link is at your own risk.

The Site is provided "as is" and "as available". Information on the Site is for general informational purposes only and does not constitute professional, legal, tax, investment or engineering advice. We do not warrant that the Site will be uninterrupted, error-free, or free from harmful components.

To the maximum extent permitted by applicable law, BRKS Labs shall not be liable for any indirect, incidental, special, consequential or punitive damages, loss of profits, revenue, data or goodwill, arising out of or in connection with your use of the Site. Our total liability in connection with the Site is limited to EUR 100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

You agree to indemnify and hold BRKS Labs harmless from any claims, damages and expenses arising out of your breach of these Terms or your misuse of the Site.

We may update these Terms from time to time. Updates take effect when published on this page. Continued use of the Site after changes constitutes acceptance of the updated Terms.

These Terms are governed by the laws of Ukraine, excluding conflict of laws principles. Any dispute arising out of or related to these Terms shall be resolved by the competent courts of Kyiv, Ukraine, without prejudice to any mandatory consumer protection rights you may have under the law of your country of habitual residence.
